By accessing or using Atticus ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

We may modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

Atticus is a social media scheduling application that allows you to:

  • Connect multiple social media accounts
  • Create, schedule, and publish content across platforms
  • Manage media files for your posts
  • View scheduling calendars and post analytics

3. Account Registration

To use Atticus, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use Atticus to:

  • Violate any laws or regulations
  • Infringe on the intellectual property rights of others
  • Post content that is defamatory, obscene, or harmful
  • Distribute spam, malware, or other malicious content
  • Impersonate any person or entity
  • Violate the terms of service of any connected social media platform
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated means to create accounts or abuse the service
  • Interfere with or disrupt the integrity of our services

5. Content Responsibility

You retain ownership of all content you create and schedule through Atticus. You are solely responsible for:

  • The accuracy and legality of your content
  • Ensuring you have rights to any media you upload
  • Compliance with each platform's content policies
  • Any consequences of content published through our service

By using Atticus, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing our services.

6. Third-Party Services

Atticus integrates with third-party social media platforms. Your use of these platforms through our App is also subject to their respective terms of service and privacy policies. We are not responsible for:

  • Changes to third-party platform APIs that affect functionality
  • Actions taken by third-party platforms regarding your content or accounts
  • Temporary or permanent loss of access to connected platforms
  • Data handling by third-party platforms

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or security reasons. We are not liable for any losses resulting from service interruptions.

8. Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activities
  • Your use negatively impacts other users or our systems
  • We receive valid legal requests requiring termination

You may delete your account at any time through the App settings. Upon termination, your right to use the service ceases immediately.

9. Disclaimer of Warranties

ATTICUS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTICUS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Atticus and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
